The "usual practice" is to specify illegality. If it is not specifically illegal then it is legal. The problem with a law that declares something "legal" is that one could argue something else that is not specified as "legal" now becomes "illegal" by default because you did not say it is "legal".

Regardless, we all suffer from the industry's efforts to keep their pockets filled.
