You're using Tiger though... and i'll wager this is probably as much a
Spaces related issue, as one tied to Exposé exclusively. Palettes and other "floating" type windoids in apps not written with full Spaces-compatibility in mind often cause the sort of behavior(s) described above. [not that Spaces itself is any model of perfection as yet.]
So to summarize, yes: it may appear that Exposé in Leopard+ exhibits the problem... but its genesis is probably a lack of compatibility with some aspect of Spaces. [and
possibly it can be minimized by tweaking some setting in Spaces... else, ask Adobe.]
